1. These terms

These terms govern your use of foxy23shop.com and any purchase you make from it. By using the store or placing an order you accept them. If you do not accept them, please do not use the store.

2. Who may order

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You must provide accurate and complete information at checkout.

3. Products, descriptions and pricing

We describe every item as accurately as we can. Colours vary between screens, and the colour you see on your device may differ slightly from the garment. Fabric, print and cut may vary between pieces where an item is block printed or hand loomed; this is a property of the material, not a fault.

All prices are shown in US dollars (USD) and exclude any sales tax, which is calculated at checkout where it applies. We may change prices at any time, but a change never affects an order we have already accepted.

Where an item is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than fulfil it. We will tell you before we do.

4. Orders and acceptance

Your order is an offer to buy. We accept it when we send your dispatch confirmation, and a contract is formed at that point. Until then we may decline or cancel an order — for example if an item is out of stock, if we cannot verify your details, or if we suspect fraud. If we cancel, we refund you in full.

5. Payment

Payment is taken at checkout through our payment providers. By submitting payment details you confirm you are authorised to use the payment method.

6. Shipping, delivery and risk

Shipping timings, rates and regions are set out in our shipping policy, which forms part of these terms. Delivery estimates are estimates, not guarantees. Risk in the goods passes to you on delivery.

7. Returns and refunds

Returns, refunds and the handling of damaged or incorrect items are set out in our return and refund policy, which forms part of these terms. Nothing in these terms limits your statutory rights.

8. Our content

The text, photographs, graphics and design on this store belong to Foxy 23 or our licensors. You may not copy, republish or use them commercially without our written permission.

9. Acceptable use

  • Do not use the store for any unlawful purpose, or to place fraudulent orders.
  • Do not attempt to interfere with, probe or overload the store or its systems.
  • Do not scrape, harvest or resell our content or product data.

We may suspend or refuse service to anyone who breaches this section.

10. Disclaimers and limitation of liability

The store is provided as it is. We do not warrant that it will be uninterrupted or error free. To the fullest extent the law allows, our total liability for any claim connected with an order is limited to the amount you paid for that order. Nothing here excludes liability that cannot lawfully be excluded.

11. Governing law

These terms are governed by the laws of the State of California, and any dispute will be heard in the state or federal courts located in San Joaquin County, California.

12. Changes to these terms

We may update these terms as our store or the law changes. The version published on this page is always the current one, and the version in force when you ordered is the one that applies to that order.
